China Patent Agent (H.K.) Ltd. (CPA) was established in Hong Kong in March 1984, accompanying the promulgation of the Patent Law of the People's Republic of China. It is one of China's three earliest-established patent and trademark firms. Headquartered in Hong Kong, CPA also has branch and representative offices in Beijing, Shenzhen, Shanghai, New York, Tokyo, and Munich.
CPA is now one of the largest intellectual property (IP) firms in China. It has 550 staff members, including 230 patent attorneys, 30 trademark attorneys, and 85 attorneys-at-law. CPA's professional teams possess intimate knowledge of the IP laws of China, the United States, Japan, and Europe, and their working languages include Chinese, English, Japanese, German, French, Korean, and Cantonese.
CPA maintains close ties with major IP organisations worldwide, among them the World Intellectual Property Organization (WIPO), International Association for the Protection of Intellectual Property (AIPPI), Licensing Executives Society (LES), International Trademark Association (INTA), International Federation of Intellectual Property Attorneys (FICPI), All-China Patent Attorneys Association (ACPAA), China Trademark Association (CTA), China Intellectual Property Society (CIPS), and China Society of Copyright (CSC). The firm's top management have been playing a leadership role in a number of influential IP organisations in China.
CPA has good cooperative relations with enterprises, law firms, as well as academic and research institutes from around the world, and provides both domestic and foreign clients with IP services including prosecution, litigation, mediation, licensing, assignment, and counseling in the areas of patent, trademark, copyright, domain name, and anti-unfair competition. China Patent Agent (H.K.) Ltd. (CPA), as one of the earliest patent and trademark firms in China, witnessed the evolution of China's intellectual property (IP) industry over the past decades, and has been contributing to the building and development of the Chinese patent system.
CPA actively promoted the Chinese IP system leveraging Hong Kong as a platform after the promulgation of the Patent Law of the People's Republic of China in March 1984. It hosted the Conference on the Chinese Patent Law in Hong Kong, and received at its Hong Kong headquarters the commissioners of the patent offices of Germany, Japan, and the United States; director general of the World Intellectual Property Organization (WIPO) and a number of IP delegations, with a view to deepening the world's understanding of the Chinese patent system and strengthening foreign countries' confidence in China's resolution of building an effective IP protection system, thus playing a facilitating role in the creation of the Chinese patent system.
CPA launched in 1985 China Patents & Trademarks, the first Chinese-English IP quarterly in China. The journal connects China with the world and fosters understanding of its legal and business environment in relation to IP laws and practice in particular, and has been well-received with industry-wide acclaim. In 1987, CPA authored the Chinese-English bilingual book titled An Introduction to the System of Industrial Property in China, which is one of the earliest special treatises introducing to overseas readers the patent and trademark system of China.
CPA was entrusted to convene a meeting to facilitate the discussions between the Chinese IP expert group and Hong Kong IP lawyers before the handover of Hong Kong to China in 1997. On several occasions the firm was consulted by the Office of the Intellectual Property Office Meeting under the State Council, the Chinese Patent Office, the Chinese Trademark Office and other competent authorities, to provide assistance in addressing the legal issues relating to the application of relevant international treaties in Hong Kong and the protection of IP rights after the handover. The firm not only has contributed significantly to the founding of the Hong Kong IP system under the framework of "one country two system" after the return of Hong Kong, but also continues to contribute to the ongoing IP development in both China and Hong Kong.
CPA actively participated in the building and improvement of the Chinese IP system. In the course of formulation and revision of China's Patent Law, Trademark Law, Measures for the Registration of Computer Software Copyright, and Regulations for the Administrative Protection of Agricultural Chemicals and Pharmaceuticals, CPA, in the capacity of industry expert, actively communicated with relevant Chinese authorities to assist in the revision and improvement of relevant laws. Additionally, CPA general managers' frequent assumption of the roles of chairman in All-China Patent Attorneys Association (ACPAA) and vice-chairman of China Intellectual Property Society (CIPS) also enables the firm to contribute to the building and development of the Chinese IP system.
CPA regularly participates in global IP events, enabling the voice of domestic IP industry to be heard internationally. The firm is a regular participant of annual meetings, international conferences, and global patent congress hosted by major IP organisations including the International Association for the Protection of Industrial Property (AIPPI), the International Federation of Intellectual Property Lawyers (FICPI), the International Trademark Association (INTA), the Licensing Executives Society International (LESI), and the American Intellectual Property Law Association (AIPLA). On some of these occasions, CPA holds receptions and its representatives deliver keynote speeches, allowing the voice of the domestic IP industry to be heard in an international context.
CPA supports the cultivation of talents to benefit the industry's future development. It has set up CPA Scholarship and CPA Study Tour Scholarship for students of Peking University Law School majoring in IP and Sino-German College of Shanghai Tongji University, with a view to supporting the nurture of top-tier legal professionals and patent attorneys with international vision, integrity, and creativity.
